The influence of habits and customs that the pre-Islamic Ḥijāz Arabs made on the structure of Islam have continued to occupy a significant position in both the East and West. The relationship between Islamic law and pre-Islamic customary-law is an important area of research that has warranted further investigation. This thesis clarifies such significant questions along with key concerns centred on the emergence of Islamic law, thereby, uncovering the roots of the legal system from a jurisprudential perspective.
